Abstract


This article critically examines the Chinese law of succession, navigating through its Roman legal origins and intrinsic Chinese cultural features. Focusing on the interplay of ‘reception’, ‘resistance’, ‘return’, and ‘re-elaboration’, it unveils how the new Chinese Civil Code meticulously melds the foundational principles of Roman law with the distinct cultural and social ethos of China. The analysis underscores the delicate equilibrium between global legal influences and national identity, illustrating the dynamic fusion of Roman legal foundations with Chinese characteristics within the sphere of inheritance law.
