Abstract


The discovery of the «Villa del Giurista» shed new light on the Roman civil procedure called agere per formulas. The
Institutiones of Gaius gives a static and an ahistorical picture through of the representation of the partes formularum and the
typical standardization of actions with formulae, in ius or in factum, representing only the final precipitate of this new civil
procedure. The new ancient source cracks this static picture of the new Roman civil procedure, giving us a glimpse of the
history of his origin and of the role that Roman jurists have played in this context, also demonstrating how posterity was of
this role for several generations fully aware.
